General Terms And Conditions Of Sale

These General Terms and Conditions of Sale (“Terms”) apply to all sales by Pave-link Pty Ltd trading as Outdoor and General (“Supplier”) to any purchaser (“Purchaser”).

Definitions

  • Supplier: Pave-link Pty Ltd trading as Outdoor and General
  • Purchaser: Any person or entity purchasing from the Supplier
  • Goods: Products or materials supplied by the Supplier
  • Quote: Formal price offer valid for 30 days unless stated otherwise
  • Sales Order / Order: Confirmation to supply Goods based on an accepted Quote
  • Tax Invoice: Issued once full payment is received prior to supply

Entire Agreement

These Terms constitute the full agreement unless otherwise agreed in writing. Any Purchaser terms are excluded unless accepted in writing by the Supplier.

Orders & Payment Process

Orders can be placed in person, by phone, or online. The process includes:

  • Quote: Outlines pricing, stock, and shipping/pickup; valid for 30 days.
  • Sales Order: Issued once Quote is accepted; requires written confirmation.
  • Tax Invoice: Issued upon full payment. Goods are only prepared, released, or delivered after payment.

Made-to-order or custom items require a 50% deposit to commence. Full payment is required before delivery or pickup.

No order is final until full payment is received. Changes must be confirmed in writing.

For made-to-order items, a 50% deposit is required before production. The balance is due before delivery or collection.

Quotes

Quotes received before 10AM will be processed the same day. Requests received after 10AM on Fridays or over the weekend will be quoted the next working day.

Payment, Pickup & Delivery

Payment:
All orders are reviewed before payment is requested. Once your order is submitted online or via enquiry, we will confirm product availability, calculate shipping, and finalise pricing. You will then receive a formal Quote or Sales Order for approval and payment.

At Outdoor & General, we do not currently accept online payments. Payment is made after confirmation, typically over the phone or via direct arrangement with our team.

All orders must be paid in full before goods are released for pickup or delivery. Delivery charges, if applicable, will be clearly itemised on your Quote or Sales Order. Additional charges may apply for remote areas, forklift hire, or special delivery requirements — we will notify you of any extra costs before requesting payment.

Pickup:
Pickup is available from our warehouse at 23 Canterbury Rd, Punchbowl NSW (next door to Club Punchbowl). Please allow up to 2 hours for same-day pickup and 24 hours for standard collection unless otherwise arranged.

Notify us before arriving to ensure your goods are ready. Visit our office first to receive any necessary paperwork. Customers (or their agents) must follow all site safety instructions and are responsible for ensuring their vehicle is suitable and loads are secured. Loading constitutes acceptance of goods.

Shipping & Delivery

Processing & Dispatch:
Orders are processed Monday to Friday (excluding public holidays). Orders generally take up to 2 business days to process, pack, and dispatch. Delivery of in-stock items usually occurs within 2–3 business days. For Sydney metro deliveries, allow up to 5 business days from order placement.

Once dispatched, you’ll receive confirmation by email. Most deliveries are completed within 24 hours of leaving our warehouse, depending on your location and volume of orders.

Delivery Terms:
We deliver kerbside only, to the address provided at checkout or on your sales order. If you wish to change the delivery address, notify us immediately via email. If you require forklift assistance or access inside your property/site, this must be arranged and confirmed in writing. Additional fees may apply. You are responsible for any damage caused by access requests beyond kerbside.

If no one is on site, the driver will attempt to contact you. If unsuccessful, goods may be left in a safe area at the delivery location or returned to our warehouse. A redelivery fee will apply if returned.

Delivery Site Requirements:
Ensure your site is safe and accessible. On delivery, you (or your representative) will be required to sign for the goods. This confirms that goods have been received in full and without visible damage or error. If no one is available, you must inspect the goods upon return and notify us of any issues within 48 hours. Claims made after this period may not be accepted.

Pricing & Adjustments

  • All prices exclude installation or other services unless stated.
  • Errors or supplier price changes may result in adjustments.

Variations to Specifications

The Purchaser may request changes to the colour or specifications of Made-to-Order Goods by providing written notice before manufacturing begins. The Supplier will not proceed with any variation unless confirmed in writing by the Purchaser.

If a variation affects cost or delivery time, the Sales Order will be adjusted accordingly.

If production has already commenced at the time the request is received, no changes can be made, and the Purchaser remains liable for the Goods as originally ordered.

Any Made-to-Order Goods must be accompanied by a non-refundable 50% deposit prior to commencement of production.

Custom & Special Orders

Custom orders, made-to-order goods, and non-stock items:

  • Require a 50% deposit to begin production
  • Are non-refundable and non-returnable
  • Must be paid in full before collection or delivery

Colour & Natural Variation

  • Stone and other materials may vary in colour, tone, texture, and dimension.
  • These are natural variations and are not considered defects.

Sale of Seconds

“Seconds” are sold as-is and may include colour, texture, size, and surface defects. The Purchaser must inspect and accept these conditions before purchase. No claims, returns, or credits will be accepted on seconds under any circumstances.

Quantity Estimates

The Supplier does not accept liability for over or under estimation of required quantities. Any excess materials delivered or manufactured will be treated as a new Sales Order.

Completion of Goods

Once Goods have been manufactured or prepared, the Purchaser is liable for full payment—even if they have over-ordered, no longer require the Goods, or are not ready to accept delivery. The Supplier may charge for any storage costs incurred and reserves the right to require the Purchaser to take delivery promptly.

Cancellations

The Purchaser may cancel a Sales Order by providing written notice to the Supplier prior to the commencement of manufacture or dispatch of the Goods.

If cancellation is accepted, the Purchaser must pay:

  • Any actual out-of-pocket expenses incurred by the Supplier; and
  • Any reasonable administrative or handling costs up to the date of cancellation.

Made-to-order or custom items cannot be cancelled once production has commenced. Full payment is required in such cases.

Delivery & Risk

  • Delivery times are estimates only and are not guaranteed.
  • Goods are delivered kerbside at the Delivery Point or a nearby accessible location at the Supplier’s discretion.
  • If requested and agreed in writing, the Supplier may deliver beyond the kerbside; however, the Purchaser accepts full liability for any resulting damage, injury, or loss, and agrees to indemnify the Supplier accordingly.
  • It is the Purchaser’s responsibility to ensure the Delivery Point is safe, secure, and accessible. Extra costs incurred due to difficult access, unsafe sites, or additional handling requirements will be charged to the Purchaser.
  • If delivery cannot be completed (e.g. no one is present or access is obstructed), the Supplier may:
    • leave the Goods at the Delivery Point at the Purchaser’s risk, or
    • return the Goods to storage. In this case, all associated storage and redelivery costs are payable by the Purchaser.
  • Once a signed delivery docket or receipt is obtained at the Delivery Point, delivery is considered complete and accepted.
  • Risk in the Goods transfers to the Purchaser upon delivery or collection.
  • The Purchaser must inspect all Goods immediately upon receipt or pickup.
  • The Supplier is not liable for any damage or loss occurring after delivery, unless caused by the Supplier’s proven negligence or wilful misconduct.
  • Pallets used for delivery are either left with the Purchaser or collected later, subject to the manufacturer’s conditions.

Inspection & Acceptance

The Purchaser must inspect all Goods immediately upon delivery or pickup.

Any claims for damage, defects, shortages, or incorrect items must be made in writing within 2 business days. Goods subject to a claim must be kept aside for the Supplier’s inspection.

Signing the delivery docket confirms full acceptance of the quantity, colour, and quality of the Goods. If collected by a courier or agent, they are deemed authorised to sign on the Purchaser’s behalf and accept the Goods as delivered.

Use & Installation

  • Once Goods are cut, installed, or used, they are considered accepted.
  • The Purchaser is responsible for suitability and correct installation.
  • Any issues post-installation are not the Supplier’s responsibility.

Returns & Refunds

Please choose carefully when placing your order, as refunds and returns are limited and provided at the discretion of Outdoor & General. We recommend reviewing all items in your cart carefully before checkout, especially for made-to-order products.

Eligibility for Return
Returns are only accepted under the following conditions:

  • Goods must be unused, in original packaging, and not installed, altered, or damaged.
  • Return requests must be made within 7 days of pickup or delivery.

Goods must not be:

  • Custom-made or made-to-order
  • Sold as “Seconds” or second-quality
  • Broken or chipped if under 5% of the total quantity (considered acceptable wastage)
  • Returned due to change of mind, incorrect selection, or price matching

Returns will not be accepted without prior written approval. If approved, a 25% restocking and handling fee will apply. Return freight is the customer’s responsibility.

Goods Damaged or Missing on Delivery
You must inspect goods upon delivery. Any damage, missing items, or irregularities must be reported within 2 business days. Please leave damaged goods untouched for inspection and possible collection. Where possible, we will re-deliver replacements promptly.

Natural and manufactured stone products may have minor imperfections or colour/texture variations. Up to 5% breakage or irregularity is considered standard and is not refundable. We recommend ordering at least 10% extra to allow for cuts, waste, or future spares.

Batch Variations
Natural stone and clay-based products may vary in colour, size, and texture between batches. These variations are not grounds for return. To minimise visible variation, lay materials consistently from each pallet, band, or crate.

No Returns After Installation
Once goods are installed, they are deemed accepted for quality, colour, texture, and finish. No refunds, credits, or exchanges will be provided after installation. Please seek advice before using cleaning or sealing products, especially on natural stone — acid-based cleaners may permanently damage the surface.

Over-Ordering & Surplus Stock
Excess goods due to over-ordering are non-returnable. We recommend keeping spares for future repairs or add-ons, especially for items that may be discontinued or hard to match later.

Installation of Goods

Once the goods have been unpacked and installed—whether partially or fully—the purchaser is deemed to have accepted them. From this point forward, no claims regarding the goods’ colour, texture, size, quality, or suitability for purpose will be accepted. Installation constitutes use, and any such use voids the right to return or seek remedy for cosmetic or suitability concerns.

Subcontractor Disclaimer

Outdoor and General is a trading name of Pave-link Pty Ltd.

While we supply and recommend products suitable for professional installation, we do not engage installers on behalf of customers. Any installation work is to be arranged directly between the customer and their chosen tradesperson.

If the customer chooses to use Pavelink Pty Ltd for installation services, this will form a separate agreement for services, independent of the sale of goods. Customers are encouraged to confirm scope, pricing, and warranty terms directly with the installer.

Retention of Title

  • Title remains with the Supplier until full payment is received.
  • The Purchaser grants the Supplier a security interest under the PPSA.

Force Majeure

The Supplier is not liable for failure or delay caused by events beyond its control including natural disasters, strikes, accidents, or transport issues.

Warranty & Liability

a. The Supplier honours all rights under Australian Consumer Law (“Non-Excludable Rights”).
b. Where permitted, liability is limited to repair, replacement, or refund.
c. No liability for indirect or consequential loss (e.g. profits, downtime, goodwill).
d. The Supplier is not responsible for product misuse, improper installation, or damage from environmental conditions.
e. Warranty claims are processed via the manufacturer.

Instalments

The Supplier reserves the right to deliver by instalment. Failure of the Supplier to deliver any instalments shall not entitle the Purchaser to cancel the balance of the Sales Order. In the event of the Purchaser making default in respect of any instalment, the Supplier may elect to treat the default as a breach of contract relating to each other instalment.

Waiver

A waiver by the Supplier of the breach of any provision of the Sales Order shall not constitute a waiver of any other breach of such provision or any other provisions.

Severability

If any part of these Terms is deemed invalid, the remainder remains enforceable.
